Any sport has inherent dangers especially if sport products are used and used incorrectly. Land Sailing can involve speeds up to 25 mph or more in a strong wind, so accidents can occur. Therefore please read our statement of limited liability and product warranty :

Liability Waiver:

As a condition of purchase and before operating the WIND CHASER® the purchaser will from the date of purchase, indemnify and hold harmless Action Products®, LLC, and any entity or individual ever associated with Action Products®, LLC including sponsors and retail organization, from any and all liability, causes of action, claims, demands, costs or debts of any kind or nature, incurred or arising from or out of the purchaser’s or other’s use of the WIND CHASER® on land or ice, or any other place or surface whether brought by the purchaser, his/her heirs, executors or assignees or by third parties.

Wind Chaser® Warranty:
|
|
Action Products®, LLC hereby warrants the Wind Chaser® against any defective parts of the Wind Chaser® for 90 days from date of purchase.
The warranty will NOT apply where:
A. Repair has been made, or attempted to be made by purchaser or others.
B. Unauthorized modification or alterations have been made.
C. The Wind Chaser® has been abused, misused, or improperly maintained.
IN NO EVENT SHALL ACTION PRODUCTS, LLC. BE LIABLE FOR ANY INDIRECT INCIDENTAL OR CONSEQUENTIAL DAMAGES FROM THE SALE OR USE OF THE WIND CHASER®. THIS DISCLAIMER APPLIES BOTH DURING AND AFTER THE TERM OF THE WARRANT. ACTION PRODUCTS, LLC™ ALSO DISCLAIMS WARRANTIES OR “MERCHANTABILITY” AND FITNESS FOR A PARTICULAR PURPOSE.
